IntroductionThis Terms of Use Agreement ("Agreement") is a binding legal contract between Agencys.ai ("Company", "we", "us", or "our") and the agency owner or entity ("Subscriber") accessing and using our services, which integrate Voizer.ai with the Go High Level CRM ("Services").

By registering for, accessing, or using our Services, Subscribers acknowledge and agree to abide by these Terms. We reserve the right to modify or update these Terms at any time, and continued use of our Services signifies acceptance of such changes.Service Subscription and UsageOur Services are provided to agency owners to facilitate the integration of Voizer.ai with the Go High Level CRM. Subscribers are required to connect their own Twilio and/or carrier services to effectively utilize the product.

The use of our Services is contingent upon a monthly subscription, the fees for which, along with any purchased credits, are non-refundable under any circumstances. Agency owners, as our direct clients, are fully responsible for their resale of the Services to their clients, including ensuring that all use is in legal and ethical compliance with applicable laws and regulations.

Any misuse or misconduct by the agency owner’s clients is the sole responsibility of the agency owner.

Server and Technical Issues DisclaimerAgencys.ai and Voizer.ai shall not be held responsible for any losses, damages, or disruptions caused by server downtime, technical issues, maintenance, repairs, modifications, updates, or any other similar events that may temporarily interrupt or suspend the operation of the software or services, including but not limited to Voizer.ai and Agencys.ai. Such events, beyond the control of Agencys.ai and Voizer.ai, may result in the unavailability of services or features.

In the event of server downtime or technical issues, Agencys.ai and Voizer.ai will make reasonable efforts to restore the services promptly. However, Agency owners of Go High Level CRM acknowledge and agree that Agencys.ai and Voizer.ai shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from such disruptions, including, but not limited to, lost profits, data loss, or business interruptions.Agency owners are encouraged to take appropriate precautions, including backup and contingency planning, to mitigate potential losses or disruptions in the event of server downtime or technical issues.

The responsibility for safeguarding against such losses lies solely with the Agency owners.This disclaimer of responsibility for server and technical issues is an integral part of this Agreement and applies to all subscribers and users of the services provided by Agencys.ai and Voizer.ai.By continuing to use the services, subscribers acknowledge and accept the terms of this Server and Technical Issues Disclaimer.No Refund PolicyAgencys.ai operates a strict no-refund policy.

Once subscription fees or credits are purchased, they are non-refundable regardless of the level of use or non-use of the Services.

Agency Owners' ResponsibilitiesAgency owners must adhere to all applicable federal, state, and local laws, regulations, and industry standards, including but not limited to the Telephone Consumer Protection Act of 1991 (“TCPA”) and regulations implementing the TCPA. Additionally, agency owners are responsible for all aspects of A2P verification and compliance related to the use of Go High Level and governmental regulations. Agencys.ai and Voizer.ai will not be held responsible for any legal or regulatory non-compliance on the part of the agency owner or their clients.Warranty DisclaimerWe provide our Services on an "as is" and "as available" basis without any warranties or guarantees.

We expressly disclaim all express, implied, statutory, and other warranties, guarantees, or representations to the fullest extent permitted by law, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary and intellectual property rights. Subscribers acknowledge and agree that any use of the Services is at their own risk. Agencys.ai and Voizer.ai make no warranty or guarantee that the Services will be uninterrupted, timely, secure, or error-free. Where certain jurisdictions do not allow the exclusion of warranties, such exclusions set forth herein may not apply.Limitation of LiabilityUnder no circumstances, whether under a theory of contract, tort, strict liability, or otherwise, shall Agencys.ai, Voizer.ai, or their respective employees, directors, officers, agents, affiliates, or subsidiaries be liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits or lost business damages, arising out of or in connection with the Services or this Agreement, even if advised of the possibility of such damages.

This limitation of liability is a fundamental element of the basis of the bargain between the Subscriber and the Company.Cancellation and Contact Information

Subscribers wishing to cancel their monthly subscription must do so by sending an email to Support@agencys.ai.

For any other support-related queries or concerns regarding these Terms, Subscribers should also contact this email address.Compliance with LawSubscribers agree to use the Services in full compliance with all applicable laws and regulations, including but not limited to telecommunications laws, privacy and data security laws, and regulations. The responsibility for legal compliance in the use of the Services, including all communications sent using the Services, lies solely with the Subscriber.Miscellaneous

This Agreement represents the entire understanding between Agencys.ai and the Subscriber regarding the use of the Services and supersedes all prior agreements and understandings, whether written or oral. If any provision of this Agreement is found to be unenforceable, the remainder shall continue in effect.

Failure by Agencys.ai to enforce any provision of this Agreement shall not be deemed a waiver of future enforcement of that or any other provision.
